Excel Schedule of Assets, Liabilities and Financial Resources (for Negotiations in Family Law Property Settlement Matters)

In family law property settlement matters, one of the most useful working documents you can have to manage your matter is a Schedule of Assets, Liabilities and Financial Resources.

This assists women to not only keep track of the asset pool (identify all the assets and liabilities etc) but also keep track of current values (and whether there is a dispute about value) and work out potential property settlement outcomes in terms of a percentage range (which is how the Court and lawyers talk about property settlement entitlements).

To help , Women’s Legal Service WA (WLSWA) has developed a template Excel Schedule of Assets, Liabilities and Financial Resources which is available for here from our website which can be downloaded and amended. This Schedule is a Microsoft Excel document and uses formulas. It is suitable for women who are comfortable using this program.

This Schedule (once completed to the best of a person’s knowledge) can and should be taken by the client to an advice appointment with a lawyer as it reduces the time the lawyer will need for the appointment.

WLSWA runs a Family Law (Property) Legal Clinic in which lawyers (mainly private solicitor volunteers) provide one-off advice to women in relation to their property settlement entitlements or other aspects of the family law financial matter.

This Schedule should be completed and returned to WLSWA prior to, or at,  a WLSWA  Legal Clinic so the lawyer has more time to spend giving the client legal advice. If you can’t complete the Schedule, don’t worry but the lawyer will need to spend time during your appointment getting those details from you. This will then reduce the time they can spend giving legal advice.

The information in the completed Schedule is required by the lawyer so they can work out how the Family Court of WA may consider the entitlements of the parties to that asset pool and therefore what advice they are required to provide to individual clients in their matter.

Background Information Form

WLSWA runs a free Legal Clinic once (sometimes twice) a month to provide women with one-off legal advice about the family law financial matter.

To request a Legal Clinic Appointment, you need to contact our Service either by calling (08) 9272 8800 or by emailing us at [email protected].

We will need to know your full name and date of birth as well as the full name and date of birth of any other party (or potential other party) in your matter. This is required so we can do a conflict check (which we are required to do as legally and ethically we are not allowed to act for more than one party in any legal matter)

If we are able to assist you, you will need to complete this Background Information Form as best as you can and return it to us.

Once completed we will put you on our Waiting List and be in touch when an appointment time becomes available.

Please note that if you are unable to complete this please contact our Service and one of our volunteers can go through it with you over the phone.

WLSWA Family Law (Property) Legal Clinic Brochure

WLSWA runs a free Family Law (Property) Legal Clinic once a month (subject to volunteers) to provide women with one-off legal advice about the family law financial matter.

This is mainly advice about their family law property settlement matters but could also include child support, spousal maintenance, adult child maintenance or questions about court procedure or enforcement of current orders. It does not include advice about financial or child support agreements.

PDF Schedule of Assets, Liabilities and Financial Resources (for Identifying the Asset Pool in Family Law Property Settlement Matters)

In family law property settlement matters, one of the first steps required to work out what each party might get (i.e. their property settlement entitlements) is to identify the asset pool.

To assist women with this step, Women’s Legal Service WA (WLSWA) has developed a template Schedule of Assets, Liabilities and Financial Resources which is available for downloaded as a PDF here from our website which can be manually completed by anyone who is either:

  • wanting family law property settlement advice;  and/or
  • wanting to commence negotiations with the other party in their matter (usually a husband or de facto partner) to see if agreement can be reached about any property or how far apart the parties are in terms of what they each want after separation.

This Schedule (once completed to the best of a person’s knowledge) can and should be taken by the client to an advice appointment with a lawyer as it reduces the time the lawyer will need for the appointment.

WLSWA runs a Legal Clinic in which lawyers (including private solicitor volunteers) provide initial advice to women in relation to their property settlement entitlements or other aspects of the family law financial matter. This Schedule should be completed and returned to WLSWA prior to, or at,  a WLSWA  Legal Clinic so the lawyer has more time to spend giving the client legal advice.

If the the Schedule is not completed, the lawyer will need to spend time during the appointment to complete it which will reduce the time they can spend giving legal advice. The information in the completed Schedule is required by the lawyer so they can work out how the Family Court of WA may consider the entitlements of the parties to that asset pool and therefore what advice they are required to provide to individual clients in their matter.
